Adult use sales update in 2023
Cannabis sales across the country are booming this year. Some states recorded record sales this year, including New Mexico, Montana, and Maryland. The state of Maryland had total monthly sales average of more than $8.9 million. Maryland is likely to see continued increased monthly sales since legalizing adult-use in July 2023.

NYC legal weed testing failure
Cannabis consumers in New York City have been exposed to weed that is not properly health tested for mold and bacteria. Systemic failures of cannabis testing have been found at all levels of the state’s legal cannabis industry, from growers to licensees, prompting the question if the cannabis is safe for consumption. Some concerns include consumption of outdoor grown cannabis that is not properly tested for mold, and heavy metals.
This issue arose last year, when New York mandated for growers to grow cannabis outdoors only. As a result, growers struggled to meet the safety limits for mold, and bacteria. The New York Office of Cannabis Management OCM responded by removing the legal safety limits for mold and bacteria in 2022. Today, more than 40 brands sell cannabis products in New York that is not properly safety tested for mold and yeast. “It is the responsibility of the licensee… to consider any health risks to consumers”, says OCM testing guidelines for growers and processors. Though there is no limit for mold and bacteria safety in NYC, OCM still requires this information to be reported from lab results. The full article is available here.

Senate Banking Committee Approves SAFER
The SAFER bill, which aims to offer traditional banking and banking benefits to cannabis business, has been approved by Senate Banking Committee in a 14-9 vote. The bill will pass to Senate Leader Chuck Schumer, who will amend the bill before a full vote in the Senate. Schumer says he intends to address expungements and gun rights in the bill.
Other concerns regarding the bill are to improve and protect quality of life for the communities adversely affected in the past from cannabis convictions. Senator Raphael Warnock, says “Our priority cannot just be to make this SAFER Banking Act safer to protect financial institutions… we must look to make whole the communities across the country that have been hollowed out and are being hollowed right now by the war on drugs.“
For now, the SAFER Act intends to help ensure that banking institutions have procedures to identify fraud and prevent illegal activity. Also, the bill introduces subsections banks to provide greater access to deposits and loans for small and medium-sized businesses, and low income communities.
