What’s New From the World of Cannabis

Cannabis Companies Challenge Federal Prohibition
 In a bold move that could reshape the cannabis landscape,
four cannabis companies filed legal action on Thursday against US Attorney General Merrick Garland. The companies, Canna Provisions, Gyasi Sellers, Wiseacre Farm and Verano Holdings Corp, allege their businesses are harmed by unconstitutional marijuana prohibition by the federal government.
The companies have hired law firm Boies Schiller Flexner to bring the case before the US Supreme Court.

This is not the first challenge to the Controlled Substances Act. In 2005, the US Supreme Court ruled that Congress has power to outlaw marijuana federally, even though state laws allow cultivation and sale of cannabis. That was 18 years ago, since then the federal government has allowed the growth of licensed cannabis industries across 23 states and the District of Columbia. David Boies, representative from Boies Schiller Flexner, argues the circumstances have drastically changed from the 2005 verdict.

“The Supreme Court has since made clear that the federal government lacks the authority to regulate purely intrastate commerce,” states Boise.
The outcome of the case is sure to create pivotal progress for cannabis legalization in the US.

Historic Marijuana Rescheduling Recommendation Hailed

In a groundbreaking development, health officials from the Biden administration have officially recommended the reclassification of cannabis to a Schedule III substance. The decision follows the order from President Biden to the Department of Justice and the Department of Health and Human Services to review the current scheduling of cannabis. What follows is a through evaluation by the US Drug Enforcement Administration and a judicial review.

Shane Pennington, lawyer at Washington DC law firm Porter Wright, calls the event “a game changer”. Pennington comments “It’s historic. It’s the biggest thing that’s happened in cannabis reform at the federal level, ever.”
One significant outcome of federal cannabis reform is the opening of doors of legalized cannabis transport across state and country lines.
This shift also brings the prospect of reduced taxes for US cannabis companies. Lower taxes for cannabis companies can mean more growth of the cannabis industry, and greater job opportunities for cannabis workers.
US Representative and Chair of the House Cannabis Caucus, Earl Blumenauer, says, “This is a step in the right direction… I hope it is followed by more significant reforms.”

The possibility of rescheduling cannabis to a Schedule III substance brings greater hope, growth and opportunities to an industry that has long battled legal restrictions. Looking ahead, we can see a brighter future for cannabis companies, customers, and industry workers than ever before.
